•
There are exceptions to the "must be paid for the whole week" bit.
Of course Frank. Sorry, I wasn't talking about "in general" I was discussing this specific question about holidays.
• Those of you that exempt temporary workers may want to take a look at your policy vs the FLSA. If the temp is an exempt employee you MUST pay for the entire week if you close for a holiday. Period. Exempts must be paid for the whole week.
• We simply send the WH382 employer response along with a letter explaining that FMLA runs concurrent with their absense due to their WC injury/illness.
• Read your 401k plan and see what is included as wages. I would bet that insurance type "negative deductions" such as you're doing is not included as wages. So the employee couldn't contribute based on those wages. In your example, your employee w…
• Can't do that. It's illegal - http://www.ssa.gov/OP_Home/ssact/title18/1862.htm - scroll about half way down: (b)(3)(C) (C) Prohibition of financial incentives not to enroll in a group health plan or a large group health plan.—It is un…
• You don't have to worry about the weekly wage minimum either. It's allowed under DoL to dock wages in full day increments and it won't affect the exempt status.
• If it is a standard 8 hour day, and I don't take into consideration any holidays your company may give, I calculate 20 hours per week, plus 16 hours for that first week of PT (Sept 16, 17, & 18). By close of business March 2nd she will have use…
•
This employee has always taken every opportunity to miss work and because of her we are now implementing FMLA.
Do you mean, "now" like in going forward? Has she been on FMLA for all of her prior absences? From y…
• I don't know how that could be legal. You can't take anything out of my check that I don't want you to, and by option out I am telling you that I don't want 401k taken out. I don't see how you could legally ignore it.
•
My understanding of the FLSA is that for exempt employees you can only make deductions from their PTO, Sick, Vacation, Personal, etc. in full day increments except for FMLA leave, jury or witness fees, or military …
• Archuletta can sing, but he annoys me. He's always squinting. I think he's a nice kid with a lousy father (who will make his life hell and as soon as David turns 18 we'll hear about how he's suing his dad). I like David Cook. He seems like a n…
• Open cabinet doors. I HATE seeing cabinet doors open or slightly open. I have to close them. People who say "uh" when they're giving a speech. People who don't give the little wave sign when you let them pull out in front of you in traffic. Peo…
• I've been watching Kid Nation with mixed feelings. I think I'm ok with it but I wish they had stuck with older kids, maybe even 10 and up. I think 8 is just too young. I also liked the show where the boys figured out how to get the pump working…
• Pursuit of Happyness has become one of my favorites. A really great story. An easy chic flick that is great for a rainy afternoon or snuggle on the couch type weather is Chances Are. It stars Cybil Sheppard and Robert Downey Jr. Her husband is k…
• Unfortunately I think Jordin will win. I don't care for her or Melinda really. I did like Jordin but then she did a few things that led me to believe that she isn't really very nice. The night of Idol Gives Back when Ryan was awful, making her …
• A lot of the gas stations in my area stop you at $50. It infuriates my son to no end. He drives a Chevy 3500 (he's a horse trainer and needs a big heavy duty truck) and it normally takes him around $80 lately to fill it up. Oddly enough, when gas…
• Do we know the forum address?
• The link will get you right there if you copy and paste it. But for some reason when I posted it the link gets broken and only part of it is "linkable" and the rest is just in plain text.
• Our company goes all out for Halloween too. We even have a plaque in the cafe with the department winner group photo, dept name, and theme they did. We have a lot of graphic artists in one division and they've won several years in a row - of cours…
• I don't have a problem at all with Tom's beliefs. He never said that Brooke wasn't having a real problem, just that treatment should not include prescription drugs. What's wrong with that? There are many people, both male and female, that use alt…
• When I first heard the news report I called our broker. (have a long relationship with him, he's a great guy and doesn't mind being joked with). I told him about the news story and asked him, completely seriously, if our plans would cover treatmen…
• Unfortunately, this is all too common today. My son used to show horses in 4-H and there were two sisters in his group. They would hit each other (punch each other - hard), cuss out their parents, even punch their parents. We rarely saw their mot…
• We pay a lot of attention to them, but we're a gov't contractor so it's really "normal" for us.
• I hate to admit it but I was in on a prank for our benefit assistant who is leaving for vacation in the morning. I sent an e-mail to her boss, the benefit administrator telling her I was sorry for the late notice but that I had a meeting next week …
• Depends on where and if you book far enough in advance. I've played heck trying to find hotels there my last few trips up to the FL Pensacola area.
• I share your pain. Pets teach us so much, they are often "responsible" for the first time a child has to learn about illness, injury, and death. We have a dog, black lab/border collie/mutt, who is definitely not a real dog, she must be part human.…
• I guess I have to pick my hubby. Or maybe my mom, she passed away about six years ago. And there's always my son. But if I had to be truthful about it, I'd have to say Tom Cruise. Of course, one night of him is about all I could stomach, but I'…
• So you're keeping it all to yourself? Don't blame you.
• I can't count. When I went back to see what the second sentence said I thought, "Hmmm, a super model or Jimmy Buffet? Must be Buffet!" x}>
• Hubby bought his own gift a couple of weeks ago. For years he's wanted a motorcycle (he had them when he was younger) but he had a bad back and couldn't ride one. Finally had surgery in August and a few weeks ago doc gave him the ok to ride a bike…
