Voluntary veterans self-identification form

I've been researching an answer for what is probably a very simple question, if there is such a thing as a simple question as pertains to HR matters.:usa flag:

How long after an employee quits, is terminated, etc. must we retain the Voluntary Veterans Self-Identification Form which is part of our new hire packet.

As required, these form are kept in a confidential file separate from the personnel file, and I would like to dispose of them as soon as is legally appropriate.

Any assistance would be greatly appreciated.

I don't have an absolute answer on this one (never even heard of the form!), but until you get a clear answer, I would retain that form for the same duration as the regular employee files, or if USERRA has longer retention guidelines, for as long as USERRA dictates.

I'd go by the requirement for federal contractors re affirmative action, which are required to preserve any personnel or employment records for at least two years from the date of the creation of the record or personnel action. The affirmative action plan itself should be kept for the duration of the federal contract.

The Vietnam Era Veterans Readjustment Assistance Act requires documentation of "good faith efforts" and "support data" (applications, personnel records, and documentation of promotions and terminations) to be kept for 2 years.
