The company we use to do our background checks only goes back seven years. We have changed our employment application accordingly to ask if they have any convictions within the past seven years.

I didn't change my name when I got married. It's perfectly legal for a woman not to change it. If at some point down the road she does change her last name then you can deal with it then. Just make sure as stated above that you comply with all be…

I concur. When I read your post I took it to be from a disgruntled employee and not someone in HR, especially with your Forum name. Had you been taking a poll as to how much PTO other employers give and left it at that I would have thought differe…

We consider an applicant as someone who submits their resume as a result of a classified ad we have placed in the newspaper. As long as they use our method of applying (fax resume, e-mail resume, walk-in, or whatever method specified in the ad) and…

Very well put. And in Ohio we have the same scenario with our workers' compensation system.

OK, I'll "bite". What is FISH Training?

Since subscribing to this Forum I have learned a lot about HR. I have also enjoyed the conversation among Forum members. This Forum is probably the best I have encountered and I think it would do a great injustice to those of us who use this forum…

I agree with you Don. If a person is actually taking the blood pressure reading for someone else there may be some liability however, if it is an automatic unit doing the reading I see no liability. I could be wrong though. Thanks for your insight.

We grant 26 weeks of STD which includes the FML. After that if they cannot return to work they are removed from the payroll. FML for reasons other than their own serious health condition would result in the termination of their employment after 12…

Agree with TN HR. It's best that you don't do it yourself but if you must, definitely have management present. Our tests are done at the local hospital and they select the names for us using a random selection process.

No argument here Don. You are absolutely correct about this information not falling under HIPAA regulations. Still wise to keep it separate. You never know when the government might change its mind...

I agree with marc--keep them separate.

I thought I saw that there is a charge for using this program. Is that correct?

Is this ruling setting a precedent that all of us who use agency temporary help must check the status of the people they send us? Could we ultimately be held responsible if the agency isn't checking the documentation for their employees? Gives me …

Here's what you do: Take a three-ring binder. Divide the binder into five sections. Section 1 tab "Current": Current employees' I-9 forms. Section 2 tab "This Year": I-9 forms for those who separated from the payroll this year. Section 3 tab …

I'm getting the same message. If they want it posted they should make it available.

See my post dated 2/11/05 - "USERRA Amendment". I can't seem to find out very much about this either.

I have faced the same dilemma as well. What I do is merely ask the person what race they identify with and explain to them why I am asking. I've never had a problem with them giving me an answer.

Yahoo!, Hotmail, mail.com, there's a lot of anonymous e-mail providers you can use to set up a temporary address.

File the claim with your workers' compensation carrier. If this employee files with the company's health insurance carrier and the employee states they hurt themselves on the job, in all likelihood the company's health insurance carrier will deny t…

We do post-accident drug testing--always have. In Ohio, "The burden of proof is on the employee to prove that the presence of alcohol or a controlled substance was not the proximate cause of the work-related injury. An employee who tests positive …

If this person will be on your payroll they must complete the I-9 Employment Eligibility Verification form. They would not be a citizen but "A Lawful Permanent Resident (Alien # A ____)" which must be recorded at the top part of the form where they…

I agree with Don. Don't sit around and wait for the OFCCP to contact you. If they do and you don't have an AAP, they can be brutal. Even if you have an AAP they're very tough. Get in touch with someone to see if you qualify and if you do, get to…

Good luck sohappytobe. I would have done the same thing you did. I'm sure you'll find something where you won't be taken advantage of. Keep us posted.

You'll get through it safety. Just hang in there and take Don D's advice.

Safety: I do it that way as well. Some is in WordPerfect, some in Access, some in Excel. I send mine out for someone else to do the availability factor forms. I thought perhaps some software could make it a little less painful but at that cost--…

I never realized the software was that expensive. Guess I'll just continue to do it the old fashioned way too. It is very time consuming. Thanks for your replies.
