• Age and gender are considered for individual policies, along with pre-existing conditions. Past experience is the major determinant, with ages and gender as a secondary factor, in group insurance.
• We have ee's who are on intermittent FMLA with chronic depression. We allow it to run its course because our attorneys advise us we would probably lose in a court of law if we took action against the ee for calling in to say they would be late or ab…

• I had read about B2 (Riboflavin) as a help for those who have environmentally triggered migraines. (I could feel every severe weather front before it came through the area and had a much better track record at predicting rain than our local weatherm…
• As I said in my first response, if it is a performance issue, which I suspected, you need treat it as such. Make sure you have documentation and then deal with the real issue. That's someone who gives real migraine sufferers a bad image.

• I am responding to your comment about a "free ticket." Please try to be more sensitive to the fact that migraines are not something a person wants, unless there is something about this individual you know but did not say. Some suffers will vomit an…

• I had lunch with my client and we are going to change the policy to pay the differential. Thanks, all!!
• Thanks for the input. I agree if they want to be generous, do so by paying only the differencebut I wanted to make sure my thinking fit in with any legal requirements.
• The client who deals with disabled veterans is sensitive when anyone is called to duty and wants to make sure the family is taken care of without having to wait for the paycheck to arrive. I have no experience with military pay so I don't know if th…
• The reason you can establish a logical cause and effect is because, although there are many causes and they may be different for different individuals, many suffers have established some of the triggers specific to them. Many sufferers have kept det…
• Thanks all. I am putting it in writing and wording it to say that the offer that he did not accept is being rescinded.
• I feel pretty comfortable that we can rescind but since we did not make an offer in writing should we rescind in writing. The owner wants to do that and I am not sure if that is wise.
• Blanket offer, although everyone does drug test. Actually, I am not sure he realized it was an offer. The owner of the company thought he made the offer and that the candidate was to call to say when he could start. Instead he called to say he had q…
• We just went through the process for a non-resident and received the paperwork today saying our H-1B Visa application was approved for October 1, 2004, the start of the next fiscal year. If you are going to go for an H-1B, you need to do it fairly q…
• I am curious as well. Doesn't the company sponsoring the H-1B have to pay to have the person return to their native country when employment ends unless they can find another employer to pick up the sponsorship?
• If your cafeteria plan has a medical reimbursement FSA, depending upon how it is administered, you may be dealing with PHI (i.e. receipts list medical conditions and drugs). If you have access to PHI, it needs to be protected.
• Be careful that you don't forget cafeteria plans when you are deciding whether or not you have to do anything. If you do medical reimbursement and have 50 or more enrollees, you are a covered entity under HIPAA.
• Thanks guys. I feel better already x:'(
• Thanks all. We have spoken to a lawyer who specializes in this. We will submit the documents March 1, requesting they be considered asap in the new fiscal year. Right now she is able to work because she does have a work authorization for one year bu…
• Sorry for being thick. I haven't done this before --- even if it says it is an "Employment Authorization card"? Under terms and conditions it says,"Student: optional practical trng" but I am being hopeful.
• Thanks, James, I will check into this. We are also in the development stage of the services we want to provide to our clients.
• Ones that are commonly used are Profiles, Omnia, Myers Briggs, and others. You can learn more by doing a search to find their websites.
• To MSHR: I ran into the issue of payout of accrued vacation upon termination recently. I had always heard you had to pay out but did the research through the DOL and found out that it is not covered under FLSA and you do not have to pay out accrued…
• If having an FSA means we have to be compliant, Carie, may I please have a copy of the letter to employees as well? ffields@msfrost.com I will send it on to the next requester once I have it.
• Thanks Don, you are confirming what I thought. My question now is, do I have to give 21 days to anyone other than the protected class (I believe I have to do that) or can I give a week, for example?

• E Wart, I totally agree with you. Management would not let me call her and tell her not to bother coming in when she left the message saying she was getting on the treadmill. They did say if she didn't show up I could send a certified letter. Unfort…

• Thanks for the welcome back. I am in a new position. I think I have gone to the dark side. This employee has been a problem for a long time but it is just recently coming to a head. I am afraid she may have a substance abuse problem and may also be…
