• Interesting. I find it really odd that a doc could possibly state that an employee can work all the way up to 40 hours in a week, but not anything over that. Anyhow, while FMLA is counted in weeks - 12 weeks in a year - you do calculate hours for i…
• I'm in FL and had a similar situation happen. WC denied and his regular health insurance picked it up.
• Yes, it is still FMLA. And to continue along the same line . . . if you did have a light duty program and could bring this person back on board in a limited capacity, but he/she refused, their time away could still be considered FMLA. Because FMLA…
• Agree 100% with E Wart. Don't pay the employee a penny for the co-pays. Once WC gets the claim they will discuss with the dr. And the dr will need to recind the claim he processed with her group insurance carrier. In turn, the doc will probably …
• Exactly. We designate and notify the employee that the leave will be counted as FMLA immediately. Usually the day we are notified. We send them the forms for them to complete at the same time. Our letter reads that we are designating the leave a…
• If they are not an employee they are not eligible for wc. Contractors are required to provide their own insurance. That is one of the tests you do to determine if someone is an employee or a contractor - do they carry their own insurance (liabilit…
• But it is a benefit. It's a required benefit, but it's still a benefit. When we write federal contracts it's included in the benefit pool.
• Wow! Thanks for the compliment Don! It's been one of those days and I really could use any pats on the back I could get. I had to do a performance appraisal today that wasn't stellar and had to deal with an employee crying in my office. Then had…

• I thought you could only count FMLA going forward? Isn't there a section in the regs that say you have to notify the employee before you can count going forward? Also, is the flu considered a serious health condition? Isn't it continued care by…
• Agree with the others, don't know of anyone with a specific maternity policy any longer. We are a multi-state group and handle the state-by-state differences with a paragraph in our policies. In our disability policy we state what our policy is …
• Yes, that's correct.
• In NC if you offer health insurance you must offer it to all employees who work 30 hours or more per week. http://www.nciom.org/hlthinspgms/C10.pdf
• Do you mean elective or cosmetic? I can think of one that could be seen as both. I could see where this could be a breast reduction which could be "cosmetic" and where a breast reduction could alleviate back pain. Either way, even cosmetic surge…
• I agree that BFOQ is pretty narrowly defined. But I also think you'd have a very strong case. I would take bets that EEOC would consider your center similar to the therapy facility mentioned in the below discussion letter. http://www.eeoc.go…

• We don't. We report their missed hours to our WC carrier. If they miss enough they could be eligible for pay from the carrier. We only pay for the first day. check your state regs though, there could be something there.
• Our company has outprocessed this for years. And so did my last company. We use The Work Number. I love it, as it takes a LOT off our plates - doing more with less employees so something has to be outsourced.
• One of my co-workers has a spouse that works at SW. She has nothing but wonderful things to say about the company. They have a very nice employee newsletter (magazine) that goes out. Really cool. He brought in the one that had their employee sur…

• No law, that's company policy. However, you may have a problem with insured benefits. Most insurance plans require employees to be actively at work. If they are out for months at a time, your policies may require that you term them from the plan …
• You can dock for full days only if no work was performed on that day and there was no pto or leave available. But since this employee worked every day you have to pay her full salary. Where was her manager during this time? If I had an employee l…
• You most certainly can charge someone's PTO or leave bank in whatever increments you want. Just follow your own policy. It DOES NOT jeopardize someone's exempt status. DoL doesn't care what "bucket" of money an employee is paid from, just that th…
• Where did you hear that employers have to tell employees? Does it only pertain to federal contractors? We have it as part of our ethics policy.
• I agree Patti, the auto insurance should be primary in this case.
• Unemployment pays much less than regular wages. If someone is on SS they can only earn X per year (based on age). Most people I know that are SS are VERY careful about how much they earn so that they don't have to repay SS. That is probably what …
• Dutch is right, they'll be more concerned with the financials of the company. How does the info you're providing translate to dollars? That is what they really want to know. Show me the money! How much did it cost the company for each new hire? …
• I don't know that I would ask the question, but there are some employer assisted housing programs for HUD residents, some with matching or partial reimbursements by the government. There is also HUBZone housing, could she have been asked that inste…
