I can't point out a reg, but I do know that you cannot design your plan to incent your ee's to drop your coverage and take Medicare. Do you have a broker you can ask?

To answer your question, I wouldn't touch it with a ten foot pole. I thought they could get the necessary info from your current carrier. In my experience they look for canned census data.

I believe ERISA mandates what needs to be done in most cases. ERISA is a federal law so you want to check state laws too. If you are planning on canceling your health plan I would contact a competent benefits attorney.
