GoPats, you may want to review this opinion (FMLA2004-2-A) from the Labor Department. It addresses recertification and other issues when there is pattern of Monday/Friday absences: http://www.dol.gov/esa/whd/opinion/FMLA/2004_05_25_2A_FMLA.pdf

I agree that job descriptions are very important for FLSA and ADA purposes. Yes, it may seem like a headache to maintain them, but it'll save you much bigger headaches in the long run.

The public interest probably outweighs privacy concerns. The names are probably important for spotting nepotism. My friend told me that one media outlet printed the addresses of public officials. That is definitely going too far.

I had a boss who was as neurotic as Larry David on Curb Your Enthusiasm.

I think loud talkers are right up there. People now talk on their cell phones everywhere. They aren't even afraid to argue over the phone in front of other people. I see and hear people talking on the phone (loudly) about personal matters at work…

Thanks for all of your feedback. I am looking for something unique and would appeal to a wide variety of people. I asked around about the booblehead idea and was met with a shrug of the shoulders from a few people. The bobblehead doesn't seem to h…

I was thinking it would be a decent retention tool for employees after a certain length of service. Instead of a company pen, we'd give a bobblehead. Maybe it is a ridiculous idea. I just wanted to throw it out there as another option to what we c…

1 .If possible, you could rework schedules so that the more physically demanding jobs are scheduled for times of the day when it is cooler.2 . Require workers to take breaks and drink water (instead of just recommending them). Hold managers accounta…

The opinion is unanimous so far. Thanks for the advice. I think I have to bring it to the company's attention.

I had never heard of this theory before and I am not an expert on either website ... but I would tend to disagree with the theory. Up until recently you needed to have an email address from a high school or university to sign up for FaceBook. The …

Start with a policy that HR has to approve anything posted on company bulletin boards or in the cafeteria. In your company newsletter, you could have a classified section for all the goods and services employees offer outisde of work.

Has his negative attitude come up in performance appraisals? One way to handle a negative employee is to challenge him to come up with a better solution when he complains about one area or another. He'll either stop complaining or actually find a b…

I think most companies aren't addressing the issue of pandemic flu even though the government keeps stressing the importance of preparing. My company has taken steps to prepare, but I haven't done anything personally to prepare my home, such as cre…

President George W. Bush would love to pass a comprehensive bill but it looks like the bill is on life support. For conservatives the most controversial aspect of the bill is the path to legal status for illegal aliens. Some Republicans may not sup…

I remember reading about a similar case. I found a summary of it on the Department of Justice website. I think it has since been settled. I hope it helps: http://www.usdoj.gov/crt/religdisc/newsletter/focus_13.htm Suit Alleges Religious Discrimi…

The Democrats are promising to revise the law so the deadline will be 180 days of the last biased paycheck. Of course, they also promised to increase the minimum wage within the first 100 hours of taking over Congress. It only took them an extra 125…

Guinness tie? Brilliant! Seriously, it was a case of poor judgment, but you don't want to draw any other conclusions. One reason is that the Americans with Disabilities Act protects people who have a problem with alcohol from discrimination.

Instead of trying to stop her, bring in better snacking options for you and your co-workers. I think the most important thing is to have options. Another key is to be informed about the food you consume. When I bring in food, I also provide nutrit…

I think it's OK for gifts to go from boss to subordinate but not from subordinate to boss. If someone gives you a gift but you haven't gotten them a gift, I think a simple thank you card would show your appreication. You may want to add that person…

I wonder if this would fall under the Americans with Disabilities Act. One of the requirements of the law is to provide a reasonable accomodation to a disability so a qualified employee can perform the essential functions of the job.

To keep morale from dipping, you should probably offer an incentive for employees to come into work. A lot of people plan trips for thw weekend before Memorial Day and changing those plans is more difficult than you'd find with other holidays.

I have seen companies get in trouble for treating a 'star' differently. This comes up in discrimination cases because some companies look the other way if the star brings in a lot of money.

By the way, I just took a look at the the April 2007 edition of the Labor Department's "Regulatory Agenda" and it mentions OFCCP's revisions to correspond with the new EEO-1 report. The agenda has a date of June 2007 for the proposed regs, but I d…

I haven't heard anything yet. I believe OFCCP is reviewing its regulations and it hasn't proposed revisions ... yet.

You could keep small hand weights in your office and do some curls while you read your email in the morning. You could also take a 5-minute break to do some pushups and situps in your office or cubicle. If space is a factor, you could do a modified…

We offer flexible schedules and found employees really appreciate them. One issue that I have noticed is in scheduling meetings among people who work an alternative work day. If one employee works 10am to 6pm and another works 6am to 2p, there's onl…

People try explaining away the gender gap by saying women leave the work force to raise kids. OK, that might explain part of the difference. But studies like that one find the main reason .... discrimination.

We evaluate employees in the major functions of their jobs, rate them on a scale of 1 to 4 in those major functions, weight the areas on how important they are to their jobs, and come up with a final score for the employee. The form itself includes …

I read about the Philadelphia Eagles reimbursing employees who purchase wind energy. Is this something that is feasible in other places? Does anyone know how this works? How do you go about purchasing wind energy in the first place?
