Since we "require" glasses, leather gloves and Kevlar gloves as part of our safety program, we furnish all PPE and replace as needed at no cost to the EE. I could only imagine the uproar we would have trying to make someone pay for something that t…

There may be "loopholes" where you could legally pay this individual a lump sum or bonus for this project, but I agree with Marc, don't take that chance. If this EE became disgruntled and made that one phone call stating that he had worked XX numb…

My first response would be, "What is he smoking?" and then without more info, it sounds like it may be a situation pertaining to housing or child support. There is no way I would allow this to happen no matter how many waivers he signed.

Dynamite - Unless the great Commonwealth of KY has been given exemption from the FLSA, what Don D. wrote is correct. Unless you are in the public sector, there is no such thing as "comp" time. Now.. there is nothing wrong with an ER telling their …

>We have about 20 staff we have classified >exempt. > > If something is not broken, don't fix it. If these EEs are currently exempt and they still qualify under the new criteria, why do you have to do anything? What is, is, and wi…

That is how it was explained at a seminar I attended as well.

> >(base wkly salary/total hours actually worked)/2 >= overtime rate for that week > So by following this formula, if you have an EE that makes %500. a week and he works 50 hours, his rate for the 10 hours of OT would be $5.00?? (…

How have you been calculating OT?? You will need to be consistent in what you have been doing or there might be that one disgruntled EE that feels they may be due OT.

If you have ascertained that there was some physical touching/pushing, then E Wart probably had a good solution. Then you have "done something about it".

We DO intend to interview the other two as I stated in my post, however I'm seeking opinions on how others would handle the situation. Without sitting in on the interview, listening to how and what was said, watching body language and then b…

Don't know if it will work out where each don't hate the other or you or the third party but, make sure you have signed written statements from all involved before you have your meeting. Analyze the facts and act accordingly.

There might not be a federal or state law requiring any compensation, BUT, how many times do you think an EE would come in only to be sent home and get nothing? We rarely have nothing at all for an EE to do. Painting..cleaning..organizing.... How…

Smaces is right on going forward. Surely the ADP system will have an option that pulls out OT hours for each pay period, not $$$ but hours. If not, the only alternative I can offer is to get lots of paper, pens and batteries for your calculator.

I was wondering how Pork was claiming to be an Editor of some State Law Letter.

"Wax on - Wax off" I knew Mr. Miaggi (?sp) should have been paid better wages!!!!!

I think that 6 Sigma is a methodolgy statistical training certificate program used in manufacturing. The terminology has been tossed around here but am not real familiar. I think there are different "Belt" levels such as green, brown and black jus…

The first thing I would do is let whomever is over your office manager to start looking for a new one with a little tact!!!!! I would love to have my Law Degree and represent the EE that was terminated.

Unless the great state of Michigan has a law concerning vacation pay, you may have a policy stating how you will pay vacation. I have worked where you had to take a full week, minimum of one full day, and currently we allow vacation to be taken in …

Not to make light of your situation which I know absolutely nothing about, but just tell them to EAT MORE SPINACH !!!!!!!!!! POPEYE

As Mushroom said in the post below, it depends on what your policy reads. We also unfortunately count vacation time as hours worked when calculating OT, but you do not have to.

Shadowfax brings up a good point. I would make certain that this position meets the criteria for exempt!!!

Welcome aboard!!

There have been numerous threads on this topic. Do a search and you will have lots of reading material.

But, since I volunteer my >services anyway, it's no big deal. I do get a >turkey at Christmas. x:-) I bet it gets deep fried!!!!!!!

You are correct that USERRA does not specifically address other "time off" benefits. While all of our reservists monthly duties are on week-ends, we also allow them the time off for their 2 weeks of active duty and give them the option of being pai…

I would agree with your assessment of taking advantage and would definitely deal with that from a discipline standpoint. Unfortunately we allow vacation to be taken in as little as 1 hour increments but will under no circumstance allow an EE to wor…

We had a supervisor terminate (with HR blessing) an EE yesterday for the same scenario. We have a no-fault attendance policy and this EE had served a 3-day suspension less than a month ago. She volunteered to work on Sat. and called in 5 minutes a…

Although we are not a union facility, we do utilize a seniority system for vacation requests. In fact, this week we are allowing our EEs to fill out a written request for their first week of vacation. The supervisor for each dept. will then compile…

No policy to share but would caution you to be extremely careful how you would word and administer such a policy. Not only would it be an accounting/recordkeeping nightmare, I can envision some real morale breaking situations. It has always been m…

Sheila, It will depend on what your company policy is. There is not a Federal Law that states you have to pay anyone Holiday Pay. It is totally a "Benefit" provided by the company. As with anything you have not dealt with in the past, you will be…
