Interesting article. Some of the comments made good points too, though I always find it amazing how many people are willing to publicly be an idiot just to get attention.

Hallelujah! 6 was good, though I liked 10 too. The best part was the writer's comments.

It sounds like the father has a terrible influence on his children. The kids will suffer the most, but if I was using him for a lawyer I would change to a new one. His comments that he tried to discourange them are ludicrous.

We haven't had any RIF's, but the tax credit would not have any impact on us. Last summer we did hire a student and used the tax credits we could. The tax credits helped justify it, but it wasn't a deciding factor.
People will take advantage of any situation if given the opportunity.
Hey! I resemble that remark! Being short has nothing to do with my vote for putting short people in a protected class. Are you i…

Beth and I tend to ignore control freaks, and that's why we didn't get it immediately. That's my story and I'm sticking to it.

FMLA is the one exception to the FLSA. You can dock partial days or use vacation or sick leave in smaller increments than usually allowed.

See. That's why I knew I was being a sucker. ::angryface::

I vote for protection for short people!

Sigh (I'm such a sucker!) Control freak who?

Sometimes a second job is allowed. It just depends upon the circumstances. For instance, there was a court case where the employee got fired for working a second job when off on FMLA for work-related stress. She didn't have stress at the 2nd job,…

Ok, we have finalized the details and sent out the information. Our contest begins Monday, and will run for 6 weeks. We are figuratively walking to the Empire State Building. We will have 2 teams (half of employees in each though participation is…

I have not seen this, and sent an email off to our owner company as the idea makes sense. Then I did a google search (privacy policy and job applications) and came up with several. The ones I saw (Glaxo Smith Kline, Beet Street) were almost identi…

It's a good idea, Paul, but do people who 'drunk text' really know they are not just texting?

I think it would be wiser to train managers and write a policy on proper use by managers. You can't police this and forbiding it entirely might backfire in court. Hope your lawyer gives you good advice and keeps your managers out of trouble. Good…

3 things supervisors should know: 1.) Treat employees fairly, without bias, and all while keeping your 'Politically Correct' hat on. 2.) Make sure you have a witness when having the 'big discussions.' 3.) Complete all your training and when in do…

khenning: these are great ideas! Thank you for contributing, and seeing as this is your first post, WELCOME to the forum!

First, you can't hold the employee responsible for the miscommuncations. I agree with your final determination. If push comes to shove, this employee could probably find someone who could state she needed the leave for mental health, which would q…

Commissions are taxed the same as other income. 401k, life insurance, etc, Plan Documents should all state which income is applicable. In our case, we have a special clause that includes sales commissions for 401k, but it is excluded as far as lif…

I get mine electronically. Problem solved.

It sounds like you would be a threat to win to me. You would not care if you were under weight; it would be short term but the victory lasts forever.

If you are even wondering if this person is dangerous, then the person is dangerous (even if it is only to the mental health of you and your employees). If you have an EAP, call them immediately and get their help on how to handle this employee. I…

Does no one have any suggestions or stories for me?

Paul, did you think you were our band leader? I know we haven't talked about the band for awhile, but I think you forgot which part you play.

How will you track this? What if someone has FB friends and gets a promotion? Will you require them to un-friend their co-workers? What if you hire a manager who heard about your job via a FB friend? Will they have to un-friend them? I think th…

Investigate, then fire the culprit and maybe even the person who hired him. I am always shocked when I read such horror stories of sexual harrassment and other obvious illegal and negative behavior by management. How do such stupid people end up i…

Love it Frank. How about this one? What's the difference between a lawyer and a leech? A leech will drop off after its victim dies. (M Lee Smith lawyers excluded.)

You must accept certification from foreign providers the same as you would here. If you have any doubts, you can have a physician here contact the provider there, or you can pick a physician in the location and have the family member visit them for…

I used to work for a TPA, and it sounds to me like the changes you have made have caused adverse selection. Our owner company is a hospital (traditionally medical providers have higher utilization), and they are spending less than half per covered …
