  • What you have described is "engaged to wait" and it is compensable. If the employee could just be reached via telephone or a pager and given time to come in, then it might be "waiting to be engaged" which is not compensable.
  • Sorry, no openings right now. That range is what we pay for any admin. We do have some clerks who make considerably less.
  • You might try searching Salary.com for info. The salaries are a little high in most cases, but at least it is a start. I'm in Texas and have paid anywhere from $25k to $36K.
  • I wouldn't dock their sick time if they worked 4 hours. If we have someone who has used up all the sick time and still come in to work part of a day to get paid for the full day, we have a discipline problem. Unless they are able to complete all t…
  • Our policy is: Exempt employees who are absent due to illness for more than half a day will have their banked sick leave reduced in half day increments. If they come in and work for more than 4 hours, they are not charged. If they come in and w…
  • Even if they don't cross a state line, you may still have an exemption due to "continuity of movement" if any part of their cargo crossed a state line. Just being under the DOT and Motor Carriers Act doesn't exempt them. You can pay trip rates if …
  • You can dock an exempt employee's pay in full day increments IF you have a bona-fide time off plan in place and the employee has exhausted all time. The risk you run when doing this is that if the employee is one who puts in long hours, weekends, e…
  • Unless the suspension is for a serious safety violation, it must be in a full week increment.
  • When I had to deal with DOL over changing pay amounts, I was told that I couldn't change the salary every pay period. I could change it; however, it had to be within a "reasonable" period. It was suggested that quarterly might be considered "reaso…
  • We do terminate and tell anyone calling to confirm coverage that they are in the election period. We tell the employees that during the time they are inactive, they will have to resubmit any claims rejected due to no election and payment of premium…
  • You don't have to pay if you have a bona fide sick leave policy in place. Hatchetman is correct. You would have to pay an exempt ee for the full week if you didn't have work available and they worked any part of the week. The sick time, personal …
  • My own doctor is in the Aetna Network and he has a sign in every examination room that states there will be a $20 charge for completing any forms. I don't know whether that came from Aetna or just his administrative staff.
  • I've not heard that before. I have heard that if an ee can only work reduced hours and the job does not readily accommodate that option, you can only charge the time they would not be working against FMLA. The case was a flight attendant you could…
  • The first time I took the test, I missed by 2 points. The test day was one day after my husband had his heart surgery. I scheduled a retest and passed with lots of room to spare. I did purchase the study modules and before I retested, I attended a…
  • I report to the COO who is also an owner. HR is valued at this company and they never miss an opportunity to tell new clients how we have impacted the bottom line for our corporate office and our clients. After meeting me, one new client told our …

  • We had restricted costumes at the Bank. No full face masks. That is a prime day for bank robbery. One of our branches was robbed and as the HR Manager, I was the first to arrive from corporate. I was dressed as a Ninja and I told the FBI man in …
  • The Pro side is that the employee is employed by both the client and the PEO (Professional Leasing Organization) All administrative reporting, payroll, worker's comp and benefits are provided by the leasing company. Many of the benefits will requi…
  • How can you hold employees accountable if they don't know about a policy? Believe me, unless you have a signed acknowledgement that they have received a policy, it will be hard to win a wrongful termination claim. Even with a signed acknowledgemen…
  • When I worked for a very large financial institution, part of my orientation every monday for roughly 20 new hires was to explain the dress code. I always made a joke out of it, but it got my message across. I would point out that the dress code r…
  • You are so right. I always gain something every time I visit. Sometimes it is just reinforcing what I knew was correct and other times it makes me look at a different perspective.
  • Potential? Yes. But,Don, what protected class is pretty?
  • ER could be employer. We all know that the employer should follow all federal and state regs; however, we also know that sometimes business decisions cause them to bend the rules. It comes down to how much risk they are willing to assume.
  • Depending on your state's requirements re pregnancy, you should treat her the same way you would treat anyone else who was missing work. Would you release a male who broke his leg playing sports on his own time during the first week of employment? …
  • Our policy includes: "It is xxx's desire to provide a drug-free, healthful, and safe workplace. To promote this goal, employees are required to report to work in appropriate mental and physical condition to perform their jobs in a satisfactory man…
  • Our policy doesn't allow for smell of alcohol alone as reasonable cause for testing. I wouldn't want to do the test on-site unless you have a medical professional do the test. That is why we don't use the urine test kits. Too much room for error …
  • At the bank, each week stood alone. If overtime was due, they got it. I remember reading (just can't put my hands on it right now) that this is acceptable under FLSA.
  • In my dealings with DOL over this issue, it was explained to me that if the salary is intended to cover all hours worked, you have to show that the employee clearly understood the arrangement. We put it in writing. Then you only pay half time for …
  • Sorry, I've tried to correct the spelling of weirdos twice and it won't change. I hate it when the type goes past the viewing area on the screen. It's hard to see what you actually typed.
