Gismo, this is a universal problem, but I've had some success dealing with it. Having a good working relationship with, and having the respect of the supervisors goes a long way. I require the performance reviews to be done by the employee's anniver…

Hi Denise. I see your from Minnetonka so I assume you are well familiar with the MN Department of Human Rights and how well they coordinate with the EEOC. I've dealt with managers like that and it becomes very critical when they are in a position…

The President herself.

Along with what Mandi and Don said, let me add that medical conditions do not excuse an employee from adhering to company policies and rules of conduct. Mr. Hyde must follow the same rules of conduct as Dr. Jeckle.

That's about the time I usually vote and, judging by the looks of the people in line with me, I'd have to say you're right, Don. Also I voted for Jesse and, I must say, it was well worth the entertainment. I believe this election law came to be und…

Here in Minnesota, Land of 10,000 Ways to Define Vague, employers must give employees time off WITH pay to vote. It does not specify how much time has to be given, but it does say that it has to be in the morning. Go figure.

Oh, I know, Crout. It's not a popular opinion and I didn't expect it to be. Seriously though, my mother would be very insulted to find her name in the same sentence with Senator Kerry. But rest easy, my friend. I won't tell her.

Irrelevant? Yes. Personal? Yes. Misguided? Yes. Poorly timed? Yes. Insulting? Maybe. I guess I'm just not "sensitive" enough. Oh, John Kerry, please help me see the error of my ways. But, shot from the hip? No.

ADA will protect recovering alcoholics, but not practicing alcoholics. And I still say it is NOT a disease.

And the handwash basins are called "birdbaths".

You are correct, Whatever. A performance review is exactly that...a review....a supervisor's opinion or assessment of an employee's performance. Based on that opinion, the employee ends up with a score of 3.7 out of a possible 5. THAT is a fact.

Scorpio, going beyond the valuable information other posters have told you, I'll explain what I do when I DO get the signed authorization allowing me to relate further information about the employee. I give facts only. For example, if asked to rate …

As long as I've been in this business, I still get nervous, upset, butterflies, etc. when faced with terminations. I've also come to realize that if the day ever comes when I DON'T feel this way, that is the day I quit. Wear your compassion, upset …

Whether you can deduct legally will come down to what your state says about it. Federal language is liberal and only prohibits deducting from paychecks if it will drive the pay below mininum wage. States, however, will usually have more to say about…

Well, Rita, I would have to say I don't believe ADA would enter in for two reasons: 1. It doesn't sound like it's a permanent condition, and 2. I don't believe you have to offer up absences as a reasonable accommodation. As to your original questio…

I thoroughly enjoyed your crayon analogy. Back in my day we even had colors with names like, "Indian Red", and "Flesh". Great take on the situation, but didn't you contradict your own post #9 where you suggested that, according to Dutch, he should b…

I agree with the other posters. This employee is trying hard to fuel his attitude. Don't fuel it and it will die off.

We heard you the first time!!

Me? I'd be singing like a little baby bird. Afterall, the a** you cover, just may be your own.

Many years ago, I was with a company that experienced the same situation. During a staff meeting, the subject came up. The owner, sitting at the head of the table and referring to our employee and her SO, blurted out indignently," Yeah, I'll bet he …

We also recently had an employee test positive for cocaine after an accident. Of course, everyone was shocked. The employee was "shocked". However, the word of the MRO is final. We are in no position to interpret or analyze drug results. Sticking to…

Our drug policy includes reasonable cause testing. An anonymous or vindictive phone call is not reasonable cause.

We've found them to be excellent workers also. In our area (Minneapolis / St.Paul) many have gone onto higher education and top professions. One is even a state representaive. I have to relate one story here of 7 Hmong children orphaned by their pa…

We're actually three different companies: a service company, a manufacturing company, and a wholesale company all owned by the same family. We are in four (soon to be five) buildings all on the same campus, so to speak. All of our employees are loca…

Speaking of managers who will be drinking again....

Hi Diane, First of all, if you want to send a private message to someone, click on the icon that looks like a sheet of paper with writing on it and wavy lines to the left of it. Second of all, if you want a job description to show her what she ough…

However, one can go from a practicing alcoholic to a recovering alcoholic in the time it takes to say, "I've had enough. I want help."

Focus on performance issues ONLY. Keep the alleged drinking problem (read ADA) out of it.
