  • We would call time off in the same work week "offset". If you offer comp time, I believe it must be given at 1.5 times. So if the employee would have been paid 4 hours of overtime, you would have to give 6 hours of comp time.
  • You can "authenticate" the FMLA documents. You provide the health care provider a copy of the certification and request verification that the information was completed/authorized by the health care provider, without the employee's permission.
  • She has been very forthcoming and open about the whole situation. I sent her the FMLA paperwork and will require a RTW certification if she wants to come back. I know her concern (other than having a premie, of course) is being able to stay home w…
  • In this instance, I have no documentation. If the employee refuses to complete the paperwork and returns to work, would you allow her to stay? I'm not saying this is going to happen, it was simply an "inquiring minds want to know" kind of thing.
  • Does your PTO policy allow for unpaid vacation time? If so, I'd chalk those 3 days up to that. That's what we would do.
  • I agree with Need Coffee on the people applying without even minimum qualifications. I'm currently looking for an IT person and have gotten a resume from someone who only has experience in retail. It's hard for me to get past a 3 page resume. I j…
  • When an employee opts (or is only under Federal FMLA), we do run PTO concurrently with FMLA.
  • In this type of situation, we have termed over the phone before. We the offer the employee a time to come collect their belongings (supervised, of course), or box up their things and tell them when they can come pick them up.
  • Very generous of you. We would allow the employee to use vacation or personal time, but probably not sick time.
  • I am NOT a doctor, but I find it very odd that an orthoscopic KNEE surgery would cause the 25 year old adult male to be unable to brush his own teeth. Last time I checked, the knee bone wasn't connected to the arm bone.
  • FMLA is for the care of a family member with a serious health condition (among other things). If he's taking it to care for his wife ,and it's certified by the doctor, yes. Taking care of the children is not a serious health condition.
  • It depends on the type of compliance! In our bank (bank vs. credit union, I know, I know) we have a Loan Compliance Officer, a GLBA/Reg CC compliance person, and a BSA officer. One falls under loans, the others under operations.
  • You may want to check your state laws as well. In WI we cannot force the use of paid time off until the employee has exhausted their WI leave and are strictly on federal leave.

  • I'm having a hard time finding IL FMLA rules, but the federal guidelines state that son or daughter is a "biological, adopted, or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis..." So, I'd say they're cove…
  • Just because her position would allow you to grant the request doesn't mean you'd always have to grant it for others. Yes, people will say that Jane got to do it, but you aren't pigeonholed into one decision (IMHO) for all employees in this case.
  • If you are subject to FMLA, the father would still be eligible for 12 weeks of FMLA leave for the birth of his child.
  • It can never be cut an dry, can it?! First, FMLA is an employer designated leave and does not have to be requested by the employee. You have provided her the forms and she refuses to complete them; therefore, her leave is not protected and she is …
  • We're currently at $3.859. I'll guess we'll top out at $4.89. Yuck.
  • It depends on your state laws. In WI, employees can use ANY accrued time during state leave, regardless of if the leave would actually qualify as sick time under our policy. We cannot force the use of paid time until state leave is exhausted. At …
  • No, no...I wasn't saying anything about semis...I was talking about the Smart Cars! I fully understand ground freight. I just think that driving in a rollerskate on a road with LARGE trucks is not so smart!
  • $3.15 around here. And it irritates the crap out of me! Dutch- Funny that the same doesn't hold true when the price of crude goes down. They're quick to raise, but rather slow at dropping. Regardless of fuel price, as long as large vehicles and …
  • I have and employee who gets borderline beligerent when I've repeatedly told him that FMLA is an employER designated leave. He says, "But I'm using sick time! What if I just don't return the papers?" I told him that based on the information we ha…
  • That is also my understanding. Employees who have other insurance coverage (secondary coverage through a spouse, for example) are also ineligible for an HSA. Neither the employer nor the employee can contribute.
  • Well...I would've lost the bet. The unpaid extra time was DENIED!!! I want to thank you all for listening and offering advice and opinions. I was close to saying, "Off with their heads!"
  • I don't have the authority to grant or deny, but did put my opinion into the people who do.
  • Some of our commercial customers use a courier service. Others have started processing their deposits and then sending us the file. Others "drop" their deposits in locked bags for us to process without them having to wait.
  • I agree that she appears to be attention seeking (and receiving). However, these ADULT men should be able to control their comments during work time; and interviews in the locker room would be considered work time. Pam Oliver would never have vent…
  • That's the plan!
  • Exactly. Yesterday I spent 3 hours talking to one of our newest tellers (who has over 11 years of banking experience, including being teller supervisor and handling BSA). She was bluntly honest, which I asked her to be. She picked up on and point…
  • Oh Nae, how I appreciate your sarcasm!!
