The law says that leave is intended for "the purpose of giving birth" (or adopting). Thus, a reasonable interpretation would be that it is available at the time of the birth or adoption, but not substantially earlier or substantially later. See (MA Gen. Laws Ch. 149 Sec. 105 D).
Is bed rest 30 days prior to estimated full gestation for "the purpose of giving birth" since an absence of bed rest may lead to a termination of pregnancy? I'm not familliar with the law, just curious about it's scope and possible overlap with FMLA.
We just had 3 women out on MA Maternity leave. It begins the moment the woman gives birth. If they go on bedrest or have any other complications prior, they would be covered by disability and FMLA.
