I work for a steel company in Indiana and we have seen a increase in our work comp claims this year compared to pervious years. We are coming up with new ideas on how to increase employee awareness so that we can cut down on the amount of claims we have had. One solution we came up with was having each person that is injured watch our safety video and take a short test over it contents. This would be done on the employees own time so he/she would not be on the clock. This raised a red flag for me because I am not sure it legal. I am new to HR work so I am wondering if this is ok to do. Can we force a employee to do this while not being on the clock? If anyone has any advise for me please let me know.

Not sure if there is anything specific to Indiana, but a general rule is that if training is mandatory, the time is compensable. Check FLSA.

I agree the time is compensable. An exception: if the training is a state requirement vs an employer requirement, then the time is not necessarily compensable. In this case it's an employer requirement

If your original purpose is to reduce work place accidents,then the viewing should be done on company time and the employee paid. If you want to alienate the guy, then make him watch it on his own time. That'll teach him to injure himself.
