OVERTIME PAY

WE HAVE AN EMPLOYEE WHO HAS TWO DIFFERANT JOBS.
SHE WORKS FROM 9:00 TO 6:00 WITH ONE HOUR FOR LUNCH. HER NEXT JOB STARTS FROM 6:00 TO 8:00 IN THE EVENING. MY QUESTION IS HOW AND DO WE HAVE TO PAY OVERTIME?

Yes, I believe so. Anything in excess of 40 hours per week. Is lunch paid? I assume the position is non-exempt?

OR the Emlployee may agree with the employer in advance to be paid o/t for the type of work that is performed during the o/t hours. For how to calculate, see 778.107 through 778.115 of the regs.

I'm sorry, I should also have referenced 778.419 for the authority to agree in advance to be plaid o/t based on the type of work being done.
