overpaid non-exempt employee

non-exempt employee was overpaid for several months due to a bookkeeping error. Can I get him to pay back the excess amount? About deduct it from future paychecks or from his annual leave bank?

  • Easy response is to say, YES---the employee s/b expected to re-pay the excess. You didn't mention any dollar amount, but since it's been on-going for some time, it's likely more than a couple of bucks!!! Most states require an employee authorization to recover this overpayment, so you'll have to determine what applies to your state. If individual balks at re-payment terms, I'd invite them to leave (termination). You might then have to decide on whether or not you pursue collection......... Hopefully you've corrected the "bookeeping error" so this does not occur again.
  • He owes a few thousand dollars and there is no policy regarding recouping overpayments. I'll check with Texas law to see if that's required. Thanks!
