Withholding Wages Federal Statute?

Does anyone know the specific Federal or Florida State statute that says an employer may not withhold wages unless by court order or employee agreement?

  • It's my understanding that Federal regs allow employers to withhold to recoup cash advances made to the employee, and in cases when an employee is convicted of or admits to misappropriation of funds. The problem is that excluding these two situations, most of the time you cannot deduct if it reduces the employee's wages below the minimum wage. This applies even if the employee agrees to allow the employer to deduct from wages.

    Don't know about Florida law. Anyone know how this applies in Georgia? All I've seen indicates that the state of Georgia is silent on this issue.
