Ohio Vacation Pay

Does anyone know if Ohio state law requires employers to pay out earned vacation pay regardless if the employee resigned according to company policy or not?

  • Earned vacation--that is, accumulated vacation--is considered payable as final compensation in Ohio. Pro rata vacation pay, on the other hand, unless specifically called for under some condition in a labor agreement, employee handbook, or other connunication, is not earned vacation, and if granted at all, payment may be based on termination other than for cause.

    According to our company policy (written under Georgia law) we only pay out Earned Time Off when and if the employee gives proper two week notice and/or if resignation is accepted early when a sufficient notice has been given.

    The ee I had in mind walked off the job. The amount of ETO he has available is a 1/2 hour and since he didn't follow co. policy I was not going to pay it out. I just wanted to make sure that it was consistent with OH state law.

    Ohio is a VERY employEE friendly state, where GA is just the opposite.
