Payroll Deductions

Does Florida law allow employers to deduct an employee's personal loan balance or other money the employee may owe the company from their final pay without their permission?

  • I don't know how laws vary from state to state, but from what I know, you MUST have something signed by the employee in order to deduct anything not mandated from their paycheck. I am planning to propose to my upper management that we make a waiver of sorts mandatory for employees so that we may deduct long distance phone calls, etc., from final paychecks. Note that you are required to give them their final check on the next payday or two weeks after termination, whichever is sooner.
