Worker's Comp paperwork retention

How long must worker's compensation notifications be kept on file? Is there a difference in retention for claims that actually lost time due to the injury and those that are simply notifications only?

I've been searching various websites to try to find this info and just can't seem to get it anywhere.

  • There is no retention schedule in the Act or regulations. How long you retain your WC records is your business decision, but medical awards pursuant to VA Code are for as long as necessary, which could be for the lifetime of the claimant if he/she still requires medical treatment due to their compensable injury. Also, wage loss benefits are available for up to 500 weeks.

    I asked my contact at my WC carrier and she advised to keep them indefinitely.
