Help me clarify something basic:

Does the FMLA allow the employee to take time off, say 2-3 weeks, prior to birth just because she's pregnant?? Or do we have to require proof of incapacity due to the pregnancy?

I totally agree with marc; get the medical certification. Don't ever treat a pregnancy differently from any other serious health condition.

Ok, I'm with you guys on this. I was thinking the exact thing at the onset of this, but based on some "gray" wording in the regs, I was second guessing it.

I agree, but, remember that you can start the FML clock early enough to count absences for the pregnancy related medical appointments, and one day related absences due to whatever it is that makes pregnant people be absent. And if you do not, you will find that you have had between 5 and 10 days of absences related to the pregnancy prior to the time you get around to starting the clock. But, again, I would never count as FML any multiple day absences without the paperwork to back it up.

Also note that intermittent leave can't be used for care for a newborn. It can be used for leave during the disability phase of the pregnancy.
