FMLA - paperwork very late

Hello everyone~
I'm new to the board and I'm so happy to have found such a great resource for FMLA questions! I know the scenario of paperwork not being returned has been addressed. But I'm wondering if an ee does return it (although it was late, I knew it was going to be late) is it ok to send them an approval letter that is backdated? I had sent them a tentative approval letter with the application because no one told me he was going out for surgery (an ongoing problem). So I do have that first letter, but I want to send him an official approval letter, should I back date it?

I would send a final approval letter confirming the start date of his FMLA. The date of the appproval letter should reflect a current date. Since you sent a tentative letter of approval pending receipt of medical documentation, to follow up the a rock solid letter establishing the start date is good practice.

I agree. Send the official approval letter reflecting the exact date. Reference the date the leave started.

I agree...stick with the current date (don't back date) but send an offical letter confirming the start date of FMLA...I like to send by Certified Mail. x:) Good Luck!
