Security Search

Looking to develop a policy for search of employee purses, bags, briefcases etc upon leaving facility.

If employees would refuse such a search it would be a voluntary resignation.

Anyone have similiar policy??

  • FASTABBY: You must be in the entertainment world of work and you want to be able to search these items for "poker chips" or rolls of coins, etc. As a business necessity you can take away the reasonable assumption of a place of privacy, by announceing and setting up guidelines and an effective date for the search of personal property taken onto the premisses by the employee inspite of the companies notification of everyone when we will start this process.

    At the same time, I would insure that the personal actions taken on anyone with company property in these personal locations are informed of the discipline associated with the execution of this event of search.

  • Are you a public or private employer? This is quite important as constitutional protections against unlawful search and seizure apply to the government. If you are a public employer, you are a branch of the government and thus more constrained in what you may do. As a private employer, you must worry about judges or arbitrators upholding actions you take as a result of what your searches uncover. They will look at the expectation of privacy your employees have. If you clearly announce your right and intention to search purses, lunchboxes, etc. then there is a much diminished expectation of privacy. Further, if you want to have a zero tolerance rule for stealing, announce that at the same time. Just remember, zero tolerance is just that and people have been discharged for stealing articles worth less than a dollar. (Supermarkets often have such policies). If all employees are treated the same, a zero tolerance policy is more likely to be upheld even if the application is harsh.
  • SEARCH AND SURVEILLANCE POLICY
    Our company has surveillance equipment in operation at all times. Be on notice that all people, property, personal belongings, work areas, vehicles, and the like are subject to search and surveillance while on/in company property.
