Cell Phone Policy

We have a lot of outside sales reps who use their personal phones. We provide some of our managers with a monthly telephone allowance. We do not have a cell phone policy in place and are wondering if that increases our liability. How many of you have a cell phone policy? If so, how do you enforce it?

Do you prohibit the cell phone's use while driving? What are they instructed to do when using it? What is the consequence if they do not follow the policy and how do you know they are not following the policy?

If you're an Employment Law Leter subscriber, you can find a good cell phone policy in the subscribers' area of HRhero.com in the Policy & Procedure Manual. It basically says "Hang up and drive," which I think is the only safe policy.

I also have a policy and an ee signature sheet which the ee signs that he/she has been advised of the policy and also acknowledges that driving and cell phone usage will comply with the policy.
