I am in the process of reviewing our employment application, I read somewhere that it is illegal to ask questions regarding a person's previous address and/or length of time at present address. Do you know which law is applicable to that rule.

  • You may want to check your state law. I don't know of any federal law that would prohibit this on an application.

  • I have a related question. I just read in SHRM's HR Advisor that is is discriminatory to request an applicant's social security number pre-hire. This information may only be obtained post-hire. However, nearly all companies providing references request the social security number to verify identity. It is also required on our motor vehicle records search for drivers which we conduct pre-offer as with other background checks (following all applicable FCRA guidelines). My question is this: Is requesting the social security number on an application truly an unlawful practice or is it merely another "preference" of DOL?
