Hiring Non-citizen

Am I required by the Department of Labor (or any law) to hire a qualified US citizen over a qualified non-citizen (i.e. an individual with a work visa, green card, etc. who otherwise meets the job requirements)? If yes, can you cite the regulation or law so that I could obtain such for my records?

NO.

All other things are never equal-- hire the best candidate.

In fact, it would be a violation of the law to favor either canidate based on national origin or citizenship status.

The only relevant question is: Does the person have the legal right to work in the United States.
