Hired to work where???

We had an employee hired full-time to maintain our buildings & grounds. He
was a non-exempt employee who worked for about 15 years. He had been maintaining
the yard at the business owner's residence (after hours & being paid at the
owner's expense). The employee has not been ill for quite some time and wanted
to quit his work at the owner's residence. He was told if he wanted a full-time
job, he had to maintain the owner's yard too, especially if he continued to
perform work after hours for other people (which he has been doing for years
also). We have a moonlighting policy but I guess this does not pertain to the
owner of the company. We employ less than 50 people and are located in Texas.
The employee quit his full-time job because of this. Was this legal on the part
of the owner?
