Question with regards to Drug Free Workplace vs. Drug Policy...

I have only worked for companies that already have an existing "Drug Free Workplace" certification. However, the company I now work for does not have one, and wants to conduct random drug testing. I need help on the clarification of our rigths only having a drug "polocy" in place. Do we have any rights to conduct testing,if so what are the stipulations with regards to action that can be taken, etc? Can anyone please help?

  • Non-DOT drug testing is a highly state-specific topic.

    However, if you intend to run random testing, I recommend that you contract out the entire process so that selection and timing of testing is not determined by your company.  The drug testing company you use should already be familliar with local requirements and the types of testing and standards required to make an employment decision.

    Check with an attorney or your state employment regulatory authority for details.
