Unemployment for Sub-Contractor

A company in VA - we had a subcontractor who was doing some work for us as needed (1099 status - not an employee). He has applied for unemployment benefits and has listed us as his former employer. Am I correct in that he is not eligible to collect as a "former employee"?

You are probably correct, but that's something for the UI investigator to determine. If the investigator grants benefits, then you look at the statute or regulation under which benefits were granted and, if you disagree, then appeal. The statute or regulation will be in the letter informing you benefits were granted.
