FMLA - STATE LAW vs. FEDERAL LAW

Have an employee who went out on FMLA in June 2009 (CT LAW -- 16 WEEKS ALLOWABLE IN A 2 YEAR PERIOD) used up all of CT FMLA just informed me she needs to go out again for another medical condition. Would now the federal FMLA 12 weeks in a one year period come in to play since she would be eligible for the Federal but not the state?
