Alcohol abuse

How do other companies handle situations where alcohol abuse in the workplace  is abused.  We have a case where an individual was out on STD due to an alcohol abuse situation and when that person returned they had agreed with the rehab to attend meetings regularly. Prior to this happening we had had several corrective action reviews with him due to poor performance and abuse of time off (unpaid time off).  The then went out on STD and it turned out he had an alcohol problem was hospitalized in a rehab for a short time and then released with the condition he would attend regular meetings. Since he has been back he has missed 3 days (PLT posted on 1/1/2011) and the smell of alcohol was noticed on him.  How have others handled situations of this type.  We do have a policy in place about drug abuse and alcohol is included.  Do we have a right to terminate since we smell the alcohol or do we have to repeat another series of corrective action sessions?
