I am not familiar with NM Law so I'll ask the following questions,
Is it illegal to ask if they were referred by an employee (maybe you
have a referral program?). 

How about can you rephrase and ask
if they know any other employees at the company?  Then there is no
mention of marital status. 

The last point I would make is that maybe you could look at this as a favoritism problem and handle it in your policy and procedures handbook where relatives can not under a department manager who is related?   Just a thought.
