Worker's Compensation Leave

We have an employee who has been out on worker's compensation leave since last May. It is questionable whether his medical condition was caused by t he relatively minor injury he received on the job; although I suppose that's actually a side issue. My question is how long do we need to keep him employed? He cannot work at all, not even light-duty. We have been keeping on our health insurance, with him paying his portion of the premium. Certainly, FMLA ran out a long time ago. When can we terminate him? Thanks!
