Overtime in California for Telecommuter

we have an employee who is moving to california and will continue to work for us remotely. as i understand it, we have to follow california law when it comes to her. she works 10 hour days monday through thursday. employees are owed overtime after 8 hours of work in a single day in california, right? does this mean we have to pay her 8 hours of overtime a week even if she is only working a total of 40 hours? is there any way to pay her straight time? or should we just change her schedule?

You should read the following wage order from the state. Go to the section with the title 5. Alternative Workweeks:

Hey, change her schedule. You are accommodating her by allowing her to stay with the company after this move.
She can work four 8-days; 4 "core hours" on Fridays, and then have flexibility in working the other 4 hours at her discretion on Friday, Saturday, or Sunday. Flexibility is what telecommuting is all about, so they say.
If she resists, you can reduce her time to 32 hours per week (Mon-Thurs).
Or you can just pay the overtime.
Remember to state in your telecommuting policy that home-based employees are not allowed to work overtime hours without prior notification and permission of their managers.
