Representation in a nonunion workplace?

We are a nonunion workplace. Does an employee have the right to have a "representative" (co-worker, relative, lawyer) present during a disciplinary meeting? This meeting is the final step prior to discharge. Any one have experience with this type of request?

  • A couple of years ago, the National Labor Relations Board ruled that Weingarten rights (to have a representative present at an investigatory
    meeting that the employee reasonably believes might result in discipline) covered unionized workplaces only. The board overruled a Clinton-era decision that extended Weingarten rights to employees in non-unionized workplaces. If a Democrat wins the presidential election in 2008, maybe we'll see another change.
