If a non exempt employee has a full time position at 40 hours a week, and works 36 hours with a holiday of 8 hours, which is a total of 44 hours for the week. Do you pay the employee 4 hours at a regular hourly rate?
Federal law does not require you to pay more than a total of 44 hours regular rate. Your state, however, may have laws regarding holiday pay. If you are union, this would be covered under your CBA. You should check your state DOL or the CBA.

We would pay their regular rate of pay for the 36 and 8 hours holiday pay.
