Mileage

We are in Maryland. Are we required, or should I say, does the IRS allow mileage to be paid for travel to and from an employee's normal workplace even if the event is held after normal business hours? Thank you in advance.

robynbell, here is a reply from Maryland Employment Law Letter editor Kevin McCormick:

I am not aware of any restrictions by the IRS on such payments. Whether those payments would be considered taxable compensation to the employee would depend on the circumstances. For example, if the employer decided to pay the employee's ordinary commuting expenses to and from work, that would probably be considered taxable compensation for the employee. If, however, the mileage payment was a reimbursement for a business-related trip the employee took for the benefit of the employer, then the payment would probably be considered non-taxable to the employee.
Whether the employer pays mileage for any employee travel is up to the employer; most do, some don't. Kevin McCormick is a partner with Whiteford, Taylor & Preston, L.L.P., in Baltimore. For more information, click here: http://bit.ly/1oLKa6A
