PTO exhausted- day off taken for exempt employee

If an exempt employee has exhausted his/her PTO time and takes a day or more off with no PTO hours, and our company has a no negative PTO policy- does that exempt employee take those days without pay?

  • If you have a legitimate sick leave/personal leave policy and the employee is taking personal leave it is possible to take a day off without pay. It is dicey though, so we don't do it here. If an employee is out of leave time and needs a day, they take it with pay. However, unless it is for FMLA purposes, we would count it against him/her in the review process. In fact, here it is unlikely that an exempt employee would get to the point of being out of leave without excess time off being addressed by thier supervisor.
