volunteer w/out work authorization?

I've been approached by a manager who would like to bring on a volunteer. This person is in school and has a student visa. The visa requires her to be enrolled in coursework in order to work. She is not currently enrolled, I'm not sure if that is because it is summer or she is taking a hiatus. Do the INS regs cover volunteer assignments?

Suggest you contact the school where the student attends. They should be able to inform you of the visa requirements. Such as the work must be related to the course work and/or the employer must work with the professor to give the student a grade for their work, etc.

Hi Dutch,

My question was not so much how to determine if the work falls under the visa requirements as it is does the fact that she is not getting paid make the visa status irrelevant.

That's why we need to close our borders! Too many illegals taking all the good volunteer positions from Americans who need them!
