Organ Donation

We have an employee who is donating his kidney to his wife. Recuperation is expected to be 2 weeks to 2 months. Since it is a voluntary, elective surgery, would it quailfy as a serious medical condition?

Once they have the surgery, they have a serious medical condition. Even if getting there is their choice, it works the same as someone who deliberately takes some other risk (ie sky diving or some other action that causes them to get hurt) and still qualifies.

I agree with Nae. As far as the FMLA serious medical condition clause goes, it qualifies.
