Can Volunteers count as employees qualifying someone as exempt!

We have employees running Senior Centers, but they have no paied staff. They will have 6-10 volunteers that they recruit, train, discipline and fire. All other aspects of executive exemption requirements is met. Can tehy be exempt?

Perhaps I need a little more info - the way I read your post, the people you're asking about are unpaid volunteers. If that is the case, the exempt/non-exempt issue really doesn't apply, as no wages are being paid necessitating overtime calculations. Am I reading it wrong?

The way I read it, the original poster said that they have [I]employees[/I] who supervise the unpaid volunteers, and they were asking if those employees could be considered exempt even though the people they supervise are all unpaid volunteers. Am I reading that correctly, dheald?

If you're thinking about using the executive exemption, I don't think it applies. It says that an employee must supervise two or more employees. It doesn't mention volunteers. Given the DOL's tendency to be sticklers for accuracy, I don't think I would classify an employee who only supervises volunteers as exempt.
