Missing I-9's

Hello All,

We did an I-9 audit and found that there are approximately a dozen missing I-9's. Idon't know if they were accidently purged, filed wrong, or what. Can we ask the employee to fill out anohter I-9, and if so, do we ask them to back date it or use the current date?

When I had this happen at a previous company, we had the employees fill out new I-9s, but NOT back-date them. Everything was filled out per the usual rules. When we added them to our file, we attached notes to each stating that on X date, during an internal I-9 audit we noticed they were missing, and therefore had employees fill a new one out. Since it was the company's first I-9 audit, we stated in the note that the omission hadn't been discovered previously due to prior lack of HR staff and no prior audits.

I think Still Needs Coffee is right on target. Also, I recommend that you conduct an I-9 audit at least bi-annually or more often (annually) if you do a lot of hiring.
