Hire Act

We have an employee who is self-employed who hasn't worked the 40 hours in the past 60 days but still currently self-employed. Do we qualify for credit?

  • I looked into the specifics for self-employed individuals under the HIRE Act this morning but, unfortunately, the IRS has not yet issued specific guidance on whether self-employed individuals (or contractors, for that matter) are qualified employees.

    For what it's worth, it seems that if self-employed individuals were meant to be excluded, then that specification would have been made in the initial definitions of "qualified employee," but that's not my professional opinion, just my two cents.
