Workers from other contries seeking empoyment in US

Are Businesses in the U.S. required to consider job seekers from other countries who do not have current Authorization to work in the US? What are the laws regarding this? If I receive unsolicited resumes from other countries and they do not have Authorization at this time. Can I simply tell them that they will not be considered for employment until they have received such authorization?

  • It is against the law to hire employees who are not authorized to work in the U.S. As an employer, you are required to obtain proof of identification and authorization to work within 3 days of employing an individual. If the employee does not present the proper documentation within 3 days of employment, the employer is required to terminate the employee.
