I was reading up on the posted information on FMLA Intermittent Leave and I have a question. An employee approached me regarding her health condition and she asked is she could use FMLA Intermittent Leave for being late everyday. She is claiming that she has a hard time getting up in the morning because of her health condition which makes her late most everyday. Of course our attendance policy does not allow an hourly employee to be no more than 8 minutes late or they receive an occurrence and a certain amount of occurrences they then receive warning letters, etc. I have given her the FMLA forms to be filled out by her and her physician. Any suggestion on how to handle this type of request. By the way this employee has been with the company for exactly 1 year tomorrow.

Even if the doctor says her condition causes her to take twice as long to get ready in the morning than normal, DO NOT accept that. Push the doctor to certify that she cannot be awake before a certain time. I guarantee the doctor will not do that.
