FMLA Forms Charges

A number of Doctors in our area are charging for filling out FMLA Medical Certifications. Has any one else experienced this, and is the organization paying for these or is the employee? The fees usually run about $25.

Yes, I see that more and more in our area.

Our personnel policy states that the employee is responsibility to provide us with the Health Care Provider's statement of serious health condition, but if we question its validity, we may require a second and/or third opinion at our expense.

It is the employee's responsibility to have the certification completed. It is also their responsibility to pay the fee if the doctor charges.

I agree with Irie. Employers did not petition to get this law; it is for the employee's protection (and therefore benefit). Further, the choice of the doctor is up to the employee.

Personally, I am glad we have FMLA. I want it to be available to me if I should ever need it, but unless the law requires that employers pay these fees we will leave it up to the employee.
