Contract to hire

We are a small company and have a design position open. Our current designer is an independent contractor living in another city. In the past we have also had this position filled by an on-site employee.

We are considering a "contract to hire" for this position. The contract would be for a 90 day period with a review at the end of the period and an opportunity to work as an employee if all parties agree.

My question is that we will be having this person sign a contractor agreement stating the terms and that they are not considered an employee for the three month period and would not be subject to wages, deductions, or benefits. They would be paid on a hourly basis with the contract worker supplying the invoice of hours worked.

Does this meet with Labor laws and has anyone had experience with the wording on these contracts?
