Divorce In The Workplace

We have a policy regarding nepotism. However, does anyone have a policy that deals with divorce and if a person can take a position or interview in an organization or department where their ex is not their direct supervsior/manager, but in the chain of command? Any legal issue with stating that is not allowed?

I'd probably avoid such a policy and use your existing policies to require appropriate behavior in the workplace.
But that's just my opinion. I'd be interested in hearing from larger employers who may have run into this issue before.
