I-9 documentation expiration confusion

Employee is hired and completes the I-9. He uses a document from List A - Employment Authorization Document I-765, with an expiration date of 5/1/09.
If May 1, 2009 comes and goes and the employee does not produce a renewed form I-765 but shows me a receipt from USCIS that he has applied for a renewal of the form I-765, what do I do with this employee? Terminate him until he produces a currently valid Employment Authorization Document or use the receipt to show he has applied for his authorization document and let him continue to work? Thanks.

Unless they apply 90 days before the expiration, they are not allowed to work until their work authorization arrives. The receipt is not good enough to extend their right to work.
