I need help in determining whether a situation is considered a voluntary or involuntary termination for determining whether an individual is eligible for the COBRA premium reduction.
Our attendance policy states that if an employee is going to be absent or late to work that he/she must call our Call-Off line one hour prior to the start of the shift. Any absence or tardiness without calling in will result in disciplinary action and may result in termination.
The employee in this curcumstance called off three times in his first 90 days of employment and was given a verbal warning. Three weeks after his 90 day Introductory Period was completed, he called off again. He was issued a second verbal warning and told that the next call-off would result in a written warning. The employee did not call or show up for work on his next 3 scheduled work days. We called him and left several voice mail messages but he never responded. Due to his failure to contact us, we determined that this was job abandonment and terminated his employment.
